What is the purpose?
Please note that your personal data shall be processed in:
*recruitment processes (including assessment of your qualifications, abilities, and skills; negotiation and communication related to your application),
*your suitability for employment/work (including references from former colleagues or/and employees, and conducting appropriate background checks if necessary),
*acting on any legal quarrels involving you or other prospective, current, or former employees, co-workers, or consultants,
*providing necessary reports to state entities.
What are the categories of personal data in this scope?
Please note that we process personal data provided by you voluntarily
*within the application documents,
*during the interview,
*during any sort of qualification tests,
*during the conversation via phone, email, in person, etc.,
*through a recruitment agency or other third party.
What is the legal basis for processing personal data?
The basis for the processing your data as a candidate is a voluntary consent stated, or through:
* an unequivocal confirmation action, consisting of including the data in the application documents, online forms, separate e-mail, text messages, chats and providing them to us, or,
*by expressing separately also voluntary consent to us for the purposes of future recruitment processes.
Also, the legal basis for processing data would be:
*labor law provisions (including in particular Article 22 of the Polish Labor Code), in the case of an employment-based contract,
*taking action at the candidate’s request prior to entering into a contract, in case of preferred employment based on a civil contract,
*in the case of recruitment of apprentices or interns - take action at the candidate’s request prior to entering into a graduate apprenticeship or intern contract.
Who are the recipients of personal data?
The data recipients shall encompass the provider of HR solutions (Bamboo HR LLC), as well as Fonn AS - All companies that are affiliated with Fonn including
- the direct and indirect subsidiary companies,
- the direct and indirect holding companies,
- any company directed by any of the above-mentioned companies e.g., via an intercompany agreement.
For the purposes set out in point 3 above, we may share your personal data also with:
*professional advisors (including lawyers, accountants, and auditors),
*legal and regulatory authorities,
Data transfer to third countries or international organizations
Your provided data shall be transferred to the United States, where our ATS and HR solutions provider is settled (Bamboo HR LLC).
(Please be aware that Bamboo HR LLC is an active participant of the Privacy Shield Framework which means that transfers of your personal data from us to Bamboo HR LLC are treated as safe)
How long do we keep your personal data?
Please note that we will keep your personal data for as long as absolutely required:
*to fulfill the purposes described in this information document,
*in order to comply with a regulatory obligation,
*in the terms of any agreement that we enter into,
*for as long as we are required by law.
After such, were allowed by this notice and applicable law, we will remove your personal data.
What are your rights?
Firstly you have the right to object to the processing of your personal data as well as also you have the right to require from us:
*the access to your personal data,
*to transfer the data that we process based on consent or agreement,
*to have the personal data corrected or removed,
*to place the limit of processing that data.
Please also note that with respect to data processed on the basis of consent, you have the right to withdraw your permission at any time, without affecting the lawfulness of the processing which was carried out on the basis of consent before its revocation.
Please also be informed that you have the right to file a claim with the Polish President of the Office for Data Protection (UODO).
Please note that this Personal Data Privacy Notice will remain in effect subject to any future changes.
We reserve the right to update this Personal Data Privacy Notice from time to time to reflect changes to the way we process your personal data or any changes to applicable law. Please also note that any future changes to the Personal Data Privacy Notice will be posted on this page.
